Do I have to pay a monthly premium for title insurance?
Title insurance is issued for a one-time fee due when you are closing or settling the real estate transaction. Coverage lasts as long as you hold title to the property.
Do I need a lawyer to close a real estate transaction?
While simple real estate transactions may be handled without a lawyer, you may want your own attorney to clarify any terms that are unclear to you in any documents you are being asked to sign. As title agents are not lawyers and unable to give legal advice.
Who usually pays?
The party responsible for paying for the policies – owner’s and lender’s — varies from state to state and sometimes from county to county. In some areas, the buyer may pay for one; the seller, the other. Cost of paying for title policies are negotiable, if you ask.
What services do title agencies provide?
Title agents thoroughly examine each title to determine if there are any flaws in the title or reasons for concern regarding the transfer of the title. The title agent also reviews the closing documents and is responsible for having such documents executed properly and for having certain documents properly filed. Title agents are responsible for disbursing funds in a timely fashion, such as paying off mortgages and other liens that affect the title. Title insurance may also provide a way to close a transaction when there are certain title deficiencies that the title insurer is willing to cover.
